Soda in schools ban passes state House, is closer to becoming law

A bill that would ban regular calorie soda from vending machines and their sale in cafeterias in Colorado passed the state House Tuesday and will be reheard in a Senate committee before going to the Governor’s desk.

The bill, SB 129 being carried in the house by Rep. Jim Riesberg, D-Greeley, aims to tackle childhood obesity in children by restricting the sale of high-sugar, high-calorie beverages in schools.

If approved, the law would mandate the state Board of Education to determine which beverages are appropriate for schools. Lawmakers say fruit juices, milk and low-calorie sports drinks will still be offered in schools.

At a committee hearing in mid-March, officials said even diet soda may still be offered at schools as part of the plan. The board will have until Nov. 15 to set the beverage rules, which will apply to all schools beginning on July 1, 2009.

Riesberg’s bill passed 37-27 on final reading of the bill Tuesday. It will be heard by a Senate committee to hear the House’s amendments to the bill before going to Gov. Bill Ritter’s desk for signature or veto.
