Man facing vehicular homicide charges appears in court

A man charged with driving drunk and killing two people, was traveling upwards of 75 mph when he collided head-on with the victim's vehicle, according to Colorado State Trooper Greg Miller.

Miller, who reconstructed the accident scene, testified Thursday in Jose Villanueva's preliminary hearing that Villanueva was driving his 1991 Nissan Pathfinder east in the westbound lane of U.S. 34, never breaking when he hit Diane Bouck and her husband, Douglas Bouck's 1998 Ford Mustang head-on.

The Bouck's, both 42-years-old of Otis, who died at the scene from multiple trauma injuries, had slowed to 10-20 miles-per-hour prior to the collision, Miller said.

Villanueva, 27, of Fort Morgan was transported to North Colorado Medical Center where he told Colorado State Trooper Robert Roberts that he had been drinking non-alcoholic wine that night.

The crash occurred March 13 at about 7:30 p.m. at mile marker 140 on U.S. 34. Villanueva's blood alcohol content at 9:15 p.m. that night was 0.148, Miller said. Colorado's legal limit is 0.08.

Jose Villanueva's, charged with two counts of vehicular homicide and a driving under the influence charge, his arraignment is set for 9 a.m. on June 16 in Weld District Court.
Weld District Court Judge Gilbert Gutierrez found there was sufficient evidence to bind over the two counts of vehicular homicide and a driving under the influence charge. Villanueva arraignment is set for 9 a.m. on June 16.
